Service Delivery Procedure
AnaitArt is dedicated to delivering professional photography services through a clearly defined and effective Service Delivery Procedure. This procedure is designed to ensure that the execution of services not only meets but exceeds client expectations, while maintaining high standards of quality and professionalism:
Initial Consultation: Our engagement begins with an in-depth online or offline* consultation to precisely understand the client’s needs, goals, and the specifics of the photography services they require. During this phase, we create moodboards, ensuring all creative elements are aligned with the client’s vision and protected under intellectual property rights.
Project Planning: After the initial consultation, we draft a comprehensive project agreement. This document outlines the timeline, key milestones, and preparatory work necessary for the project, setting a clear framework for what is to be delivered and when.
Photoshoot Execution: The photoshoot is carried out on the prearranged date, adhering to the agreed terms within the project agreement. This step is meticulously planned to balance creative expression with the client’s specific requirements, ensuring the session achieves the desired outcomes.
Post-Production: Following the photoshoot, our team conducts detailed post-production work. This phase is critical for refining the images to meet AnaitArt’s high-quality standards and aligning with the project’s predefined specifications.
Final Product Delivery: The finished images are securely delivered to the client, allowing for prompt and safe access to their photos. The delivery timeline is established early in the planning phase, guaranteeing transparency and efficiency in receiving the final products.
Feedback and Revisions: AnaitArt places a high value on client satisfaction and welcomes feedback on the delivered images. We are prepared to make necessary revisions to ensure the final products perfectly align with the client’s expectations, as detailed in our project agreement. Intellectual Property Usage Terms
After all payments for a project are settled, AnaitArt grants clients the non-exclusive rights to use the provided photographs, videos, and graphic designs for both advertising and personal purposes. Clients are authorized to use this content on digital platforms, including their own websites and social media, without geographical restrictions, for a period of five (5) years from the delivery date. Extension of these rights is possible through a written agreement mutually agreed upon by both AnaitArt and the Client.
Furthermore, AnaitArt reserves the right to include any produced content (including photos, videos, and designs) in its portfolio, which may be showcased on various platforms such as the AnaitArt website, social media channels, social media networks and other marketing materials, to demonstrate the scope and excellence of our services. This right is granted on a non-exclusive basis, allowing AnaitArt the ongoing freedom to display its work without geographic or temporal restrictions.
In instances where a client opts for confidentiality and wishes to exclude their content from our portfolio, AnaitArt accommodates such requests with a 20% increase in service fees to maintain exclusivity.
Additionally, AnaitArt maintains moral rights, requiring acknowledgment as the creator of the content in any public use by the client, unless an alternate arrangement is specified in writing.
The detailed conditions governing the rights transfer, including usage scope, applicable mediums, and rights duration, will be explicitly outlined in project agreement. This agreement acts as the definitive licensing agreement between AnaitArt and the client, guaranteeing both clarity and legal enforceability of the terms agreed upon.
Deposit and Payment Terms
Deposit: The Client shall pay a deposit amounting to 50% of the total service fee (“Deposit”) to AnaitArt (“Service Provider”) prior to the commencement of any project-related activities. This Deposit secures the Client’s booking and signifies the Client’s commitment to proceed with the services outlined in the project agreement.
Payment Schedule: The remaining balance of the service fee is due following the completion of the photoshoot but before the final delivery of the photographic content to the Client. An invoice for the remaining balance, including any additional charges that may have arisen during the provision of the service as per the project agreement, shall be issued by the Service Provider. Previews of the photographic content shown during the photoshoot shall serve as a preliminary agreement between the Service Provider and the Client regarding the quality and style of the final deliverables. The entirety of the payment process, aimed at ensuring full transparency and adherence to legal standards, is detailed within the project agreement.
Payment Method: All payments shall be made in EUR, through methods agreed upon by both parties, such as bank transfer or other electronic payment platforms, as specified in the project agreement.
Late Payments: In the event of late payment by the Client, the Service Provider reserves the right to impose a late fee of 5% per month on the outstanding balance, subject to the maximum allowed by law. The Service Provider also reserves the right to withhold the delivery of the final photographic content until full payment is received.
Refund Policy
Cancellation by Client: The conditions under which the Client may cancel the scheduled photography services and the implications on the Deposit are as follows:
- Cancellation with More Than 3 Days’ Notice: If the Client cancels the scheduled service more than 3 days prior to the photoshoot and no preparatory work outlined in the project agreement (such as mood boards, consultations, or other preparatory actions) has been commenced by the Service Provider, the Client is entitled to a full refund of the Deposit. This provision recognizes that the Service Provider has not yet incurred significant preparatory expenses.
- Cancellation with 3 Days or Less Notice: Should the Client cancel the service within 3 days of the scheduled photoshoot, or after any preparatory work has already been initiated by the Service Provider, the Deposit will be retained by the Service Provider. This is to compensate for the preparatory expenses and efforts already expended, as well as the opportunity cost of reserving the service date for the Client, which precludes other potential bookings.
- Preparatory Work Commenced: In instances where preparatory work has commenced as per the project agreement (such as mood boards, consultations, or other preparatory actions), regardless of the cancellation notice period, the Deposit will not be refunded. This policy accounts for the Service Provider’s allocation of time and resources towards the Client’s project from the outset of engagement.
Service Provider Cancellation: In the unlikely event that the Service Provider must cancel the scheduled services due to unforeseen circumstances, the Client will be entitled to a full refund of the Deposit. The Service Provider may, at its discretion, offer an alternative date for the photoshoot, subject to the Client’s agreement.
Refunds for Completed Work: Once the photoshoot has been completed, the Service Provider is not obligated to provide refunds for the services rendered. Should the Client be dissatisfied with the final deliverables, the Client may request revisions as outlined in the project agreement.
Confidentiality Agreement
Both AnaitArt and the Client recognize the importance of and agree to maintain the confidentiality of information deemed confidential that is exchanged or disclosed in the course of providing and receiving services. Confidential information includes, but is not limited to, trade secrets, business plans, strategies, client lists, proprietary software, research and development findings, and any other information that is not publicly available and could reasonably be considered confidential.
AnaitArt commits to not disclose, disseminate, or use the client’s confidential information for any purpose outside the scope of the services provided, except with the client’s explicit written consent or as required by law. Similarly, the client agrees to protect and not disclose, disseminate, or use any confidential information regarding AnaitArt’s practices, methodologies, or any other proprietary information gained in the course of the engagement, except as necessary for the use of the services provided or as required by law.
This confidentiality obligation shall remain in effect during the term of our service agreement and for a period of five years following the termination or conclusion of said agreement, irrespective of the reason for termination.
Should either party be required by a legal process to disclose any of the confidential information, the disclosing party agrees to provide prompt notice to the other party to allow the latter to seek a protective order or other appropriate remedy unless prohibited by law.
The obligations set forth in this section shall survive the termination of the agreement between AnaitArt and the client and shall continue to bind both parties, their agents, heirs, successors, and assigns.
